Welcome to AGL 365. These Terms of Service (“Terms”) govern your use of our platform and services. Please read them carefully before using the Service.
By accessing or using AGL 365 ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including business owners, agents, and team members invited to an organization.
AGL 365 is a customer relationship management (CRM) platform designed for real estate professionals. The Service includes lead management, contact tracking, appointment scheduling, task management, automated follow-ups, AI-powered insights, and integrations with third-party services such as Google Workspace, WhatsApp, and others.
To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials. You may invite team members to your organization, and you are responsible for their use of the Service under your account. Each user must have their own account — sharing credentials is prohibited.
AGL 365 offers free and paid subscription plans. Paid plans are billed monthly or annually as selected at the time of purchase. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice. Your subscription will automatically renew unless cancelled before the renewal date.
You agree not to: (a) use the Service for any unlawful purpose; (b) send spam, unsolicited messages, or violate anti-spam laws (CAN-SPAM, TCPA); (c) attempt to gain unauthorized access to other accounts or systems; (d) upload malicious code or interfere with the Service; (e) scrape, crawl, or harvest data from the Service; (f) resell or redistribute the Service without authorization.
You retain ownership of all data you input into the Service, including contacts, leads, notes, tasks, and documents. We do not claim ownership of your data. You grant us a limited license to process, store, and display your data solely to provide the Service. Upon account termination, you may request an export of your data within 30 days.
The Service includes AI-powered features such as contact analysis, task extraction, meeting preparation, and an AI assistant. AI-generated content is provided as suggestions only and should not be relied upon as professional advice. You are responsible for reviewing and approving all AI-generated messages before they are sent to your contacts. We are not liable for any consequences of AI-generated content.
The Service allows you to set up automated messages via email, SMS, and WhatsApp. You are solely responsible for ensuring compliance with all applicable messaging laws, including CAN-SPAM, TCPA, and GDPR. You must obtain proper consent from recipients before sending automated messages. We provide tools for manual review of automated messages, and we recommend using them.
The Service integrates with third-party services including Google Workspace, Twilio, and others. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or security of third-party services. You authorize us to access your third-party accounts as needed to provide the integrations you enable.
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGL 365 AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
Either party may terminate this agreement at any time. You may cancel your account through the Settings page. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it may be permanently deleted.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Clark County, Nevada.
